RUSK — Cherokee County Sheriff’s Department officers arrested a man for continuous sexual abuse of a child on Sunday.
Jack Allen Franklin Jr. is in custody at the Cherokee County Jail and awaits a court hearing on charges related to two counts of sexual abuse of a child under the age of 14 in a 30-day period.
Franklin, 43, was arrested on charges of aggravated sexual assault in 1988 in Cherokee County and served a seven year sentence, according to Detective Dusty Lee.
Lee said Franklin was not registered as a sex offender prior to the arrest.
“In 1997, the (Attorney General’s) office here in Texas made a decision that any person convicted or adjudicated of any type of sexual offense after Sept. 1 of 1970 had to register as a sex offender,” Lee said. “When he was released from prison in ‘95, that decision hadn’t come out yet, so they were not told they had to register.”
Lee said any person charged with an offense of a sexual nature needs to register with the county as soon as possible if they have not already done so.
Lee said Franklin was accused of molesting two minors in the case for which he is now incarcerated.
